Distance Sales Agreement

This agreement governs the sale of product samples ordered through allforhamam.com. By completing an order you confirm that you have read and accepted these terms.
1. Seller

2. Buyer
The person or company whose name, address, e-mail and telephone details are entered at checkout. The buyer is responsible for the accuracy of this information; incorrect address details may prevent delivery and customs clearance.
3. Subject
The subject of this agreement is the sale and delivery of the product samples listed in the order summary, which is an integral part of this agreement.
Samples are supplied for evaluation purposes in limited quantities and do not constitute a wholesale order.
4. Price and payment
All prices are stated in US Dollars (USD) and include the sample price and the shipping fee shown separately at checkout.
Payment is made in advance. The order is prepared only after payment is confirmed.
Card details are entered on the payment page of the authorised payment institution. The seller does not see, process or store card numbers.
5. Delivery
Orders are dispatched within 1–3 business days after payment is confirmed, by international courier (DHL or equivalent), on DAP terms.
Transit times are estimates provided by the carrier and are not guaranteed. A tracking number is e-mailed to the buyer once the parcel is handed over.
The buyer is responsible for providing a deliverable address and any information required by the destination customs authority.
6. Import duties and taxes
The sale is an export from Türkiye. Any import duty, VAT, customs clearance or handling charge levied in the destination country is payable by the buyer and is not included in the amount paid to the seller.
If a parcel is returned to the seller because the buyer refused to pay such charges or could not be reached, the shipping costs incurred are not refundable.
7. Right of withdrawal — hygiene exclusion
Exfoliating mitts, peshtemals, towels and similar textile products come into direct contact with the skin and are supplied in sealed packaging.
In accordance with Article 15/1-(ğ) of the Turkish Distance Contracts Regulation, goods whose protective packaging, tape or seal has been opened after delivery and which are not suitable for return for reasons of health and hygiene are excluded from the right of withdrawal.
For this reason returns and exchanges are not accepted for these products, and the buyer expressly acknowledges this exclusion when placing the order.
8. Damaged, incorrect or missing goods
The exclusion in Article 7 does not apply where the delivered goods are damaged, defective, incorrect or incomplete.
In such cases the buyer must notify the seller within 7 days of delivery, with photographs of the parcel and the goods. Where the claim is confirmed, the seller will, at the buyer’s choice, resend the goods or refund the amount paid.
Refunds are made to the original payment method.
9. Cancellation before dispatch
An order may be cancelled free of charge as long as it has not yet been handed over to the carrier. Please contact the seller by e-mail immediately.
10. Personal data
Personal data provided at checkout is processed solely for the purposes of concluding the sale, delivering the goods, issuing the invoice and fulfilling customs and accounting obligations, in accordance with the Turkish Personal Data Protection Law (KVKK) no. 6698 and, where applicable, the GDPR.
Data required by customs and tax legislation is retained for the statutory period.
11. Force majeure
Neither party is liable for delay or non-performance caused by events beyond its reasonable control, including natural disasters, strikes, carrier failures, customs interventions and changes in law.
12. Applicable law and disputes
This agreement is governed by Turkish law. The Courts and Enforcement Offices of İzmir have jurisdiction over disputes.
Where the buyer is a consumer, the mandatory consumer-protection provisions of the buyer’s country of residence and the competence of Turkish Consumer Arbitration Committees remain reserved.
